Intellectual Property Rights

Alrighty (been watching Sex in the City reruns). In my September column, I mentioned that I'm taking a graduate level class from the University of Illinois at Urbana-Champaign. I want to state right now that it's in the librarian track and not any sort of lawyer study track. And, I'm a geologist, anthropologist, ballroom dancer and web geek by nature. Although I am related to a couple of lawyers and have some as friends.

The class I'm taking is Foundations in (Digital) Data Curation; a recent class topic was the subject of intellectual property rights. The focus was on how current US law relates to the creation of digital data collections in the realm of science. But, in the back of my mind I'm always thinking about the artistic imagery collection we're collectively building at Balloon HQ, the photo database, of course.

One of the articles we read was entitled " Intellectual Property in the Context of e-Science" by D. Burk. It presents the legal definitions of the types of content that may be created by scientific researchers and how each of these content types would fall within the jurisdiction of either copyright law, patent law, legal contracts, or open source licensing. The article is written in a manner that clearly states the relevant nuances but limits the use of legal jargon, making it a very approachable document, although my class did agree that it down-played the impact of private contracts. I think it's worth a read by curious balloon artists

A follow-up discussion in the on-line chat revealed a video clip on YouTube which outlines fair use of materials protected under copyright law by making fair use of numerous commercially released movies. By the nature of how it was made, the narrative is a bit disjointed and, the makers have juuuuust a bit of a bias against some copyright holders as well. But, we feel it's worth 10 minutes of your time. Check it out: A Fair(y) Use Tale. I'm curious to see what sort of follow-up discussions pop up on the e-mailing forums.
